Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the CraftChat service ("Service"), operated by JPSM Group ("Company," "we," "us," or "our"). The Service includes the CraftChat WordPress plugin, associated cloud infrastructure, dashboard, APIs, and all related documentation available at https://craftchat.net.

By creating an account, installing the plugin, or otherwise accessing the Service, you ("User," "you," or "your") agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

CraftChat is an AI-powered chatbot plugin designed for WordPress and WooCommerce websites. The Service provides:

  • Automated content crawling and indexing using Retrieval-Augmented Generation (RAG) technology
  • AI-generated responses to visitor inquiries based on your site content
  • WooCommerce product data integration (pricing, inventory, shipping)
  • Analytics dashboard for monitoring chat interactions
  • Customizable chat widget branding and appearance
  • Multi-language management dashboard

3. Account Registration and Security

To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately at support@craftchat.net of any unauthorized use of your account

You must be at least 18 years of age or the age of legal majority in your jurisdiction to create an account. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Subscription Plans and Payment

4.1 Plans

The Service is offered through multiple subscription tiers (Free, Starter, Business, Pro, and Enterprise), each with specified response limits, domain allowances, and feature sets as described on our pricing page.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis, depending on the billing cycle you select. All prices are listed in Japanese Yen (JPY) and are inclusive of applicable taxes unless otherwise stated. Payment is processed at the time of subscription and automatically recurs at the beginning of each billing period.

4.3 Payment Methods

We accept payment via credit card (Visa, Mastercard, American Express). You authorize us to charge your designated payment method for all fees incurred under your account.

4.4 Plan Changes

You may upgrade or downgrade your subscription plan at any time through the dashboard. Upgrades take effect immediately, with prorated charges applied. Downgrades take effect at the beginning of the next billing period.

4.5 Refund Policy

All paid plans include a 14-day money-back guarantee from the date of initial purchase. Refund requests must be submitted to support@craftchat.net within 14 days of your first payment. Refunds are not available for renewal charges or after the 14-day period.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

  • Use the Service to generate, store, or distribute content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
  • Use automated scripts or bots to artificially inflate response counts or abuse the Service
  • Resell, sublicense, or redistribute the Service without our prior written consent
  • Use the Service to collect, store, or process sensitive personal data (such as medical records, financial account numbers, or government-issued identification numbers) unless you have obtained all necessary consents and comply with applicable data protection laws
  • Impersonate any person or entity, or falsely claim affiliation with any person or entity
  • Circumvent or attempt to circumvent any usage limits, access controls, or security features of the Service

6. Intellectual Property

6.1 Our Rights

The Service, including its software, design, logos, trademarks, and documentation, is the proprietary property of JPSM Group and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.

6.2 Your Content

You retain all rights to the content you provide to the Service (website pages, product data, etc.). By using the Service, you grant us a limited, non-exclusive license to access, index, and process your content solely for the purpose of providing the Service.

6.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without obligation or compensation to you.

7. AI-Generated Responses

The Service uses artificial intelligence, including third-party AI models, to generate responses to visitor inquiries. You acknowledge and agree that:

  • AI-generated responses may not always be accurate, complete, or appropriate
  • You are responsible for reviewing and monitoring the responses generated on your behalf
  • We do not guarantee the accuracy or reliability of any AI-generated content
  • The Service should not be used as a substitute for professional advice (legal, medical, financial, or otherwise)

8. Data Processing and Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you agree to the data practices described therein. You are responsible for ensuring that your use of the Service complies with all applicable privacy and data protection laws in your jurisdiction.

9. Service Availability and Modifications

9.1 Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, during which the Service may be temporarily unavailable.

9.2 Modifications

We reserve the right to modify, update, or discontinue any aspect of the Service at any time. For material changes that adversely affect your use, we will provide reasonable advance notice via email or dashboard notification.

10. Termination

10.1 Termination by You

You may cancel your subscription and terminate your account at any time through the dashboard or by contacting support@craftchat.net. Upon cancellation, your access continues until the end of the current billing period.

10.2 Termination by Us

We may suspend or terminate your account immediately if you breach these Terms, engage in prohibited conduct, or if required by law. We may also terminate accounts that have been inactive for more than 12 consecutive months.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete your indexed content data within 30 days of termination. Provisions that by their nature should survive termination (including Sections 6, 11, 12, and 13) will continue to apply.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JPSM GROUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of laws provisions.

13.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

14. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

15. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and JPSM Group regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Force Majeure: We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, or failures of third-party services.
